DATA PROTECTION AND PRIVACY POLICY

DS INCOMING MANAGEMENT SL (hereafter “CONTROLLER” or “DESTINATION SPAIN”)
is responsible for processing the User’s personal data and informing them that this data will be processed in accordance with that laid down in the current personal data protection regulations, Regulation (EU) 2016/679 of 27 April 2016 (GDPR) relating to the protection of physical persons as regards the processing of personal data and the free circulation of this data, as well as the Spanish regulations that are applicable, for which the following information on the processing is provided:

1. As a User of the Website, the General Conditions and the Privacy Policy, you accept the content of this Data Protection clause.

2. This Privacy Policy is applicable to the User while browsing throughout the Website.

3. Responsibility for the file The personal data collected by the Controller will be incorporated into a file that is the responsibility of DESTINATION SPAIN, with CIF B66251356 and registered address in Barcelona, Calle Joan Obiols, nº 15-17, A, 2º 1ª, post code 08034.

DESTINATION SPAIN will ensure the accuracy and veracity of the personal data collected; therefore, on its own initiative or at the request of the User, it will complete, rectify or delete all personal data that is incomplete, inexact or obsolete.

4. Type of data collected through the Website

DESTINATION SPAIN’s privacy policy prevents the collection of sensitive or private data of our customers or web users. Therefore, we do not request at any time data such as: racial or ethnic origin, political opinions, religious beliefs, union affiliation, genetic or biometric data, sexual orientation or data that identifies the conduct of the Users.

The only data that we request of our website Users is the name of the contact person, as well as their email with the aim of sending information on new services and products in the form of newsletters.
Moreover, we also request invoicing data from our customers for the processing, management and if applicable, invoicing of the provided service.

5. Purposes

The data provided by DESTINATION SPAIN’s customer or that results from the browsing of the website is used for various purposes that are listed below:

a) Sending of a newsletter: The information provided when the registered User creates their account may be used by DESTINATION SPAIN to send them a newsletter, as well as product alerts and other information relating to DESTINATION SPAIN, both by conventional means and by electronic means, such as email or mobile telephone, provided that the sending of these communications is expressly requested or authorised by the User.

 

If you do not wish to receive these types of communications from DESTINATION SPAIN, when you create your registered User account, you can choose not to receive future communications from us by deselecting the corresponding option on the registration form. Furthermore, the User can unsubscribe from this service from their registered User account, by email or ordinary mail addressed to the person responsible for the database. In compliance with the data protection regulations, you have the right to subscribe or unsubscribe, whenever you wish, from receiving these communications. As well as updating the email address, you can also ask to be automatically unsubscribed through any communication that you receive.

b) Sending and invoicing of orders: The information that our customers provide us with for processing their orders is used for invoicing the services that the company provides.

9. Rights that aid the User:

1. Right to withdraw consent at any time.

2. Right of access, rectification and erasure of their data and to the limitation or opposition to its processing.

a. Right of access: The person concerned will have the right to request and obtain free of charge the information on their personal data subjected to processing, the origin of that data, as well as the communications carried out or that it is intended to make with it. b. Right of rectification and erasure: the data controller is obliged to implement the right of rectification or erasure of the concerned person within 10 days. The personal data that is not being processed in compliance with the law must be rectified or erased, as applicable, and, in particular, when this data is inaccurate or incomplete, the person will have the right, without undue delay, to the rectification of the inaccurate personal data that concerns them. The person concerned has the right to the completion of the personal data that is incomplete, including by means of an additional statement.
c. Right to processing limitation: the person concerned has the right to limit the processing of their data by the data controller.
d. Right of opposition: the person concerned has the right to oppose at any time, for reasons relating to their particular situation, that personal data that concerns them (public interest and legitimate interest), the data being subject to processing, including the preparation of profiles based on these provisions. The controller must stop processing the personal data, unless it has compelling legitimate reasons for the processing that prevail over
the interests, the rights and the freedoms of the person concerned for the formulation, the exercise and the defence of claims.

The user has the right to make a complaint or claim to the Spanish Data Protection Agency (www.agpd.es).

Persons under the age of 18 cannot provide any information to DESTINATION SPAIN without the authorisation of their father, mother or guardian, nor can they enter into a contract without this authorisation, unless it is permitted by current regulations.

The legal basis that legitimises the processing of data is the general interest of DESTINATION SPAIN. The legal basis of the data that we use is based on express consent, with the aim of offering you our products and services and to keep you up to date with offers and promotions.
